Real American Beer Tailgate Contest/Giveaway

Promotion Details:

Real American Beer is hosting a giveaway at select college tailgate parties, where eligible participants can win “The Ultimate Real American Prize Pack,” which includes various brand merchandise (e.g., hat, t-shirt, koozie). There will be one winner selected at random per tailgate event.

Eligibility:

This giveaway is only open to legal residents of the Continental United States and the District of Columbia who are at least 21 years of age or older subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participants must be physically present at the tailgate event to enter. Employees, contractors, or affiliates of Real American Beer, as well as their immediate family members, wholesale distributors and retail licensees are not eligible to participate. Participation constitutes entrants full and unconditional agreement to these Terms and Conditions and Real American Beer’s decisions which are final and binding in all matters related to this contest giveaway. 

Entry Method:

To enter, attendees must scan a QR code at the designated Real American Beer tailgate area and provide their name, phone number, and email address. When entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. No other forms of entry are valid. Limit one entry per person per tailgate event. No purchase or payment of any kind is necessary for entry and a chance to win.

Promotion Period:

The contest giveaway will occur during each of the five (5) or more tailgate events. Each event will have its own entry period, starting and ending on the day of the event. Entries will only be accepted during the event hours.

Prizes:

One (1) winner will be selected per tailgate event. Each winner will receive “The Ultimate Real American Prize Pack,” which may include items such as a hat, t-shirt, koozie, or other branded merchandise (final items to be determined by Real American Beer). Winners will be notified via email from the Real American Beer team, requesting their shipping address and t-shirt size. Prizes will be shipped directly to the winners. If a potential winner does not respond to the notification email within five (5) days from the date of notification, their prize will be forfeited, and an alternate potential winner may be randomly selected. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above.

Winner Selection:

Winners will be selected at random from all eligible entries received during each tailgate event. The selection will be conducted by Real American Beer, whose decisions are final.If Real American Beer cannot verify that the potential winner is twenty-one (21) years of age or older, prior to winner notification, then the potential winner will be disqualified and an alternate potential winner will be randomly selected. Any prize notification or prize returned to Real American Beer or its agencies as undeliverable will result in disqualification and the awarding of that prize to an alternate potential winner.

Limitations:

Each participant may enter the giveaway only once per tailgate event. Multiple entries by the same individual at a single event will result in disqualification.Limit one (1) “The Ultimate Real American Prize Pack,” per person. Prize is non-transferable and no cash equivalent or substitution of prize is offered. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used. 

Disqualification:

Participants found to be under 21 years of age or those submitting more than one entry per event will be disqualified from the giveaway. Real American Beer reserves the right to verify the eligibility of any participant.

Release:

Entrants agree (a) that The Real American Beer and its parent, subsidiary and affiliated companies, and advertising and agencies, and their respective officers, directors, employees, wholesale distributors, representatives and agents, will have no liability whatsoever for, and are released and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property, or rights of publicity or privacy, defamation, copyright infringement or portrayal in a false light resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this contest giveaway or in any contest giveaway-related activity, and (b) winner, by acceptance of prize, except where legally prohibited, grants permission for The Real American Beer (and agrees to confirm such agreement in writing) and those acting pursuant to its authority to use his/her name, voice and/or likeness and prize information, and/or entry for advertising, trade and contest giveaway purposes without further compensation, at any times or time, in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval.

Publicity and Copyright License

You grant The Real American Beer an exclusive, worldwide, perpetual, irrevocable, unrestricted, royalty-free, sub-licensable and transferrable right and license to exploit your entry (including, without limitation, your name and likeness and any intellectual property rights (e.g. copyright, trademark, etc.) contained in the entry) in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to you or any third party, for any purpose, including, without limitation, your entry and any person’s property (physical, personal, intellectual property rights, and indicia) contained therein. The foregoing grant includes, without limitation, the right to reproduce, display, distribute, publicly perform, create derivative works of, alter, amend, broadcast, edit, publish, use, merchandise, license, sublicense, and adapt the entry in any and all media now or hereafter known, throughout the world, for any purpose, whether commercial in nature or otherwise, including in contexts and circumstances that result in your entry being associated with a particular The Real American Beer..

Dispute Resolution:

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the entrant and The Real American Beer in connection with the contest giveaways, or any claim or dispute that has arisen or may arise between you and The Real American Beer, shall be governed by, and construed in accordance with, the laws of the State of Delaware without giving effect to any choice of law or conflict of law rules.

General Conditions:

By entering, participants agree to abide by these Terms & Conditions and the decisions of Real American Beer, which are final.

By submitting an entry, you agree that your entry is gratuitous and made without restriction, that it will not place The Real American Beer under any obligation other than as stated in these Terms and Conditions.

No purchase or payment of any kind is necessary to enter for a chance to win. A purchase or payment of any kind will not increase your chances of winning.

Winners will have five (5) business days to respond to the notification email. If no response is received, an alternate winner may be selected.

Prizes are non-transferable and no substitution or cash equivalent will be provided.

Real American Beer reserves the right to cancel, modify, or suspend the giveaway if fraud, technical failures, or other factors, in its sole discretion,  impair the integrity of the promotion.
